The Family Team at 36 are at the forefront of family law non-court dispute resolution. 36 Family has 14 experienced IFLA arbitrators (nine qualified to arbitrate in money and property disputes and seven qualified to arbitrate in private children law disputes, including two qualified in both schemes). Many of our mid to senior ranking members accept appointments as neutrals/evaluators for private FDR tribunals in financial remedy and family property disputes. 36 Family also has several members who regularly conduct mediations in money and children matters.
36 Family is firmly committed to assisting parties to resolve their cases without the need to attend court, when it is appropriate to do so. We boast a wealth of experience in this regard, with two of our members being listed as industry leaders in the recently launched Chambers and Partners Family NCDR directory.
Chambers has a dedicated Dispute Resolution suite, with hearing and private conference/breakout rooms. Dispute Resolution appointments are usually offered in chambers, but remote sessions can easily be accommodated if it suits the parties due to their distant/international geographical location. “Special measures” can also be accommodated to ensure that parties do not come into direct contact with one another. Members of chambers are also willing to attend dispute resolution appointments at mutually agreed locations throughout England and Wales (and beyond, when so required).

We also offer an innovative combination of pFDR/neutral evaluation and mediation known as Evaluation With Mediation (‘EWM’). EWM aims to bring about the effective and quick resolution of even the most intractable cases by combining into a single process the best features of expert evaluation of the merits of case by way of neutral evaluation with the skilled guidance of an expert mediator to assist with the negotiation process. We also offer a unique ‘NCDR Triage’ service. If you have a family case (children or finances) which you would like dealt with outside the court system but you are unsure which of the various NCDR options would be best, you can arrange a short no obligation and free of charge discussion with one of our experienced NCDR practitioners. During that discussion the issues in the case can be explained and advice given as to which of the various NCDR options might be suitable and how they might work in practice.
