Successful Asylum Appeal – Protection granted for Namibian survivor of Abuse

Emma Christie recently represented the successful Appellant before the First-tier Tribunal (Immigration and Asylum Chamber) instructed by Duncan Lewis Solicitors Ltd.

The determination found that the Appellant belonged to a particular social group as a female victim of sexual abuse, and that previous abuse and threats amounted to persecution for a Convention reason. It was determined that state protection would be ineffective in her circumstances and that internal relocation would not be viable owing to the continuing risk posed to the Appellant.

The asylum claim was successful, with additional success on Article 8 grounds.

This case underscores the importance of trauma-informed advocacy and careful application of refugee law principles to cases involving gender-based persecution.
