Landmark judgment on international arbitration in Mauritius

Dr Jamsheed Peeroo successfully represented Eric Laporte before the Supreme Court of Mauritius in Laporte E.G.L v Laporte M.A.R [2025 SCJ 35], a case that provides key clarifications on the enforcement of international arbitration awards.

The judgment addresses critical issues, including:
• The need to provide suitable security under Article VI of the New York Convention when enforcement proceedings are stayed.
• Security for costs in relation to an appeal to the Judicial Committee of the Privy Council (JCPC) under the Supreme Court (International Arbitration Claims) Rules 2013.

The dispute arose from an arbitral award in favour of Eric Laporte following international arbitration proceedings seated in Mauritius. The Respondent, Marc Laporte, sought to set aside the award and resisted its enforcement. After his application to set aside the award was dismissed, he appealed to the JCPC.

The Supreme Court put the enforcement proceedings in abeyance pending the appeal and ordered MARC Laporte to (i) provide security by way of a bank guarantee for the full sum of the award under Article VI of the New York Convention and (ii) to pay security for the costs to be incurred in the appeal to the JCPC.
