John Simmons secures a rapid acquittal at Oxford Crown Court in a tragic case of Causing Death While Driving Uninsured.
Two defences were fully argued and left to the jury. Was the defendant “using the vehicle in the course of his employment” giving rise the statutory defence under s.143 RTA 1988? – Autoclenz [2011] SC 41. Were the defendant’s actions a more than minimal contributory factor to the death? – R v. Hughes [2013] UKSC 56.
The case involved an analysis of employment law as well as four experts from various disciplines around road traffic collisions and statistical analysis.
