The European Court of Justice has in Commission v Malta (Citizenship by Investment) [2024] EUECJ C-181/23 held that Malta’s post-2020 citizenship by investment programme is incompatible with EU law, stating that under EU citizenship, and by extension EU citizenship, cannot be treated as a commodity divorced from genuine connections to the Member State.
