Madeleine Whelan recently acted in a significant case concerning the legal route to acquiring and retaining parental responsibility for a non-biological father.
The case examined whether parental responsibility, once acquired through birth registration, should automatically cease upon re-registration or whether a welfare-based analysis is required.
This remains an unsettled area outside of the High Court, and the judgment contributes to the growing jurisprudence on the legal status of psychological parents.
The judgment has now been published and can be read here.
Madeleine was instructed by Oscar Smith of Expatriate Law.
