Judgment was handed down on Monday in the high-profile judicial review brought by the Palestinian human rights organisation, Al-Haq, against the UK Government regarding the supply of F-35 fighter jet components to Israel. The claim was dismissed by the High Court.
Rachel Toney acted as Special Advocate in the proceedings, working alongside Tim Buley KC and Dominic Lewis.
The case explored the legal limits of the UK’s export controls regime, the justiciability of decisions involving foreign affairs and arms licensing, and the handling of sensitive national security material. While the court did not uphold the claim, the judgment has drawn significant public and media attention to the UK’s arms export processes. Al Haq is considering its position in light of the judgment.
