Eric Fripp and Sandra Akinbolu instructed by Duncan Lewis succeed in Court of Appeal in CDX (CA-2025-002396)

Eric Fripp and Sandra Akinbolu

In 2024 the Immigration Enforcement Competent Authority (IECA) found that CDX (an anonymity order is in force) had shown reasonable grounds to suggest that he had been a victim of modern slavery, and the Secretary of State acted to prevent the IECA from considering if CDX was such a victim, by imposing Public Order Disqualification from further assessment under section 63 Nationality and Borders Act 2022.

Eric Fripp and Sandra Akinbolu were instructed by Rohena Wallace, Aya Jamal, and Silpa Patel of Duncan Lewis Solicitors Ltd. in CDX’s appeal to the Court of Appeal from refusal of permission to apply for judicial review in the High Court, Administrative Court. Permission to appeal was granted on all grounds by Arnold LJ and the appeal linked to that in R (ABW) v SSHD CA-2026-000477 (on appeal from R (otao ABW) [2025] EWHC 3280). Both appeals were listed for hearing in October 2026.

The Secretary of State has now conceded that CDX’s appeal should be allowed without the need for hearing, and his application for judicial review has been remitted to the Administrative Court for substantive hearing, with permission granted on all grounds.
