“Corruption, Nigeria v P&ID and the laws of evidence: how should international arbitration respond” by Dr. Satya T. has been published with Practical law.

In light of concerns raised in the recent decision of Federal Republic of Nigeria v Process & Industrial Developments Ltd [2023] EWHC 2638 (Comm) regarding the potential for fraud and other abuses of process during the arbitral process, Satya considers the extent to which this is addressed by the rules on the control and presentation of evidence in arbitration. Undertaking a comparative review of arbitral rules and national laws, she proposes possible solutions for ensuring greater equality of arms between parties based on the rules governing evidence in arbitration.
