Today, the Court of Appeal handed down a judgment in a significant case. William Tyler KC led the successful local authority team in resisting the appeal, alongside Giles Bain of New Court Chambers.
The judgment definitively addresses the applicability of criminal law directions and principles to the fact-finding process in the family jurisdiction. The court also considered the delicate line between acceptable and impermissible requests for ‘clarification’ of a judge’s reasons.
