When a refusal of leave to remain carries no right of appeal, procedural fairness in the decision-making process assumes particular importance. This seminar will look at the scope of procedural fairness in judicial review claims, focusing on the Supreme Court’s decision in R (Pathan) v SSHD [2020] UKSC 41, [2020] 1 WLR 4506 and the subsequent cases in which it has been applied or distinguished.
