Urgent Injunction and Disclosure Orders Secured at the High Court in Bitcoin Fraud

Racheal Muldoon of 36 Commercial has secured an urgent interim injunction and disclosure orders at the High Court while acting on a direct basis for a UK registered company that had fallen victim to Persons Unknown operating a cryptocurrency investment scam.   

The Company had transferred Bitcoin to the fraudulent investment platform in the belief that it would be invested on its behalf. Subsequent investigations by an intelligence and tracing firm revealed, however, that the Bitcoin had in fact been dissipated without the company’s knowledge or consent.  
Within 24 hours of being instructed, Racheal advanced applications for: 

i) an interim injunction to prohibit Persons Unknown from moving or disposing of the Bitcoin traced to wallets at several well-known cryptocurrency exchanges; 

ii) Norwich Pharmacal and Bankers Trust disclosure orders compelling the exchanges to release documentation to assist with the identification of the Persons Unknown;

iii) reporting restrictions; and 

iv)permission to serve out of the jurisdiction by alternative means.  

All applications were granted in full, with the interim injunction subsequently extended at the contested return hearing.
