36 Crime – Statement in Response to the AGFS proposals due to take effect from 01.04.18
Members of 36 Crime have considered the new Advocates’ Graduated Fee Scheme which it is currently proposed will be introduced on 1st April 2018. We believe that the proposals threaten the proper functioning of the criminal justice system in England and Wales, and seriously jeopardise the continued existence of the publicly funded criminal bar.
We support the Criminal Bar Association’s call to the Ministry of Justice not to implement these proposals as presently drafted, and to amend the scheme in line with the reasonable proposals put forward by the CBA.
From 1st April 2018 we will not be accepting defence instructions, whether fresh instructions or returns, covered by a representation order which falls within the proposed scheme. Our Members have confirmed their intention to take part with other organisations involved in the Criminal Justice system in targeted Days of Action to highlight the crisis in the system. We will consider escalating this action in due course.
