Martin Kingerley in important High Court case
Martin Kingerley appeared in an important High Court case which seeks to clarify the extent to which children in care are able to consent to being deprived of their liberty. This decision is likely to have a significant impact on the manner in which such cases are assessed by local authorities in advance of making decisions as to whether or not to seek the court’s permission to authorise any apparent deprivation of liberty pursuant to s100 (3) of the Children Act 1989 utilising the inherent jurisdiction of the High Court.
