William Tyler KC was successful in this important Court of Appeal case concerning whether it was necessary and proportionate to litigate, within the current proceedings, the cause of death of the mother’s child six years earlier.
The judgments are particularly interesting as the two family Judges were split (Baker LJ delivering a dissenting judgment to that of Peter Jackson LJ).
