36 Crime’s Katherine Kelleher, instructed by Sam Healey and Ellie Dales of JMW Solicitors has secured the acquittal of a client who was alleged to have assisted in a conspiracy to defraud the government of millions of pounds.
The allegations centred around a three-year project to design and build a machine that would automate the repair of aeroplane turbines, the cost of which ran into the millions. The prosecution alleged that fraudulent claims were made as part of the government grant awarded to fund the engineering initiative. The charges included fraud by abuse of position, fraud by false representation, possession, and control of articles for use in fraud, and money laundering.
Katherine, meticulously analysed the prosecution’s evidence and worked closely with those instructing her to secure expert evidence. Following the analysis of such evidence, and with strategic representations to the Crown Prosecution Service and persistent pressure for disclosure, the team successfully highlighted significant weaknesses in the case. This led to the CPS offering no evidence, resulting in formal not guilty verdicts being recorded.
This was a particularly complex case, with allegations spanning a three-year period. The proceedings required careful and strategic decisions regarding the involvement of specific experts.
