Emma Christie recently represented the successful Appellant, a Kurdish woman from Turkey, before the First-tier Tribunal (Immigration and Asylum Chamber).
The Appellant had suffered severe and sustained abuse at the hands of family members and others, including sexual violence and domestic abuse, and feared persecution if returned to Turkey.
At the hearing, Emma referred to expert country evidence concerning the situation of women who have fled domestic violence in Turkey, the extent of protection available to them, and the specific vulnerabilities of Kurdish women returning without established support networks.
The Tribunal accepted Emma’s submissions, finding that the Appellant is a member of a particular social group (women fleeing domestic violence), she had been persecuted in the past and faces a real risk of persecution again if returned, and there would be neither sufficient state protection nor a viable option of internal relocation in the Appellant’s particular circumstances.
Accordingly, the appeal was allowed on asylum grounds, with additional success on private life grounds under Article 8 ECHR.
